Working as a Behavior Analyst in Delaware

Delaware does not license behavior analysts. There is no state LBA and no behavior-analyst licensing board — confirmed absent from the BACB’s official state-licensure list. Instead, ABA practice is governed indirectly through 16 Del. Admin. Code 2102 (Autism Service Providers), issued by the Delaware Dept. of Health and Social Services, Division of Developmental Disabilities Services (DDDS). That regulation sets certification standards for insurance and Medicaid payment, not a professional license.

For a working BCBA, this is a practical shortcut. The rule states plainly that a provider “currently certified as a BCBA or BCBA-D” has already met the state’s standard to deliver ABA services. There’s no separate state exam, application, or renewal cycle before you can bill — active BACB certification plus Medicaid or MCO enrollment is what gets you paid. That also means faster mobility if you’re relocating to Delaware, since there’s no license to transfer.

One caution: at least one provider-directory site has published that Delaware licenses behavior analysts through a “Board of Mental Health and Chemical Dependency Professionals.” That claim isn’t supported by the BACB’s list or by Delaware code — don’t rely on it. (A separate “School Behavior Analyst” educator certificate exists under 14 DE Admin. Code 1585/1586 for school-based practitioners only, and isn’t a general practice license.)

RBT vs. BT in Delaware

Delaware Medicaid does not require the RBT credential specifically. Under 16 Del. Admin. Code 2102 §3.3, a “Behavioral Technician” can implement ABA treatment plans under BCBA/BCBA-D supervision by meeting Delaware’s own checklist instead: HS diploma or GED, background and abuse-registry checks, annual CPR certification, mandatory-reporting and HIPAA acknowledgments, an autism spectrum disorders course, competency-based ABA-procedures training signed off by the supervising BCBA (a current BCaBA credential satisfies this step), an ABA-principles course from a BCBA/BCBA-D, and at least 10 hours of observed training before providing 1:1 service.

For job seekers, this cuts both ways. An RBT credential still demonstrates several of these requirements at once and makes you easier to hire, but it isn’t the only path in — Delaware lets an agency build its own in-house pipeline to the same standard. For owners, that’s the real value: you can staff and train technicians locally without waiting on RBT certification timelines, as long as your supervising BCBA signs off on competency.

Supervision isn’t left to BACB best-practice guidance alone — Delaware codifies it. Per §3.3.1, supervision must run “not less than 1.5:10 per week” (1.5 hours of BCBA/BCBA-D supervision per 10 hours of technician treatment), with a floor of 1 hour per week for cases under 10 hours of ABA weekly. Build your staffing model around that codified minimum, not just around what a payer might informally expect.
